License Agreement
Definitions	The following definitions apply to the terms as they appear in this agreement: “You” and “Your” refer to any person or entity that acquires or uses this Package. “We”, “Our”, or “Us” refer to Architectural Details, Inc. “Package” means the Software, e-Catalog, User’s Manual(s), Details, and other items which may be supplied under this agreement. “Software” means the computer program(s) contained in this Package, together with all the codes, techniques, software tools, formats, designs, concepts, methods, and ideas associated with that computer program. The term also includes all copies of any part of the Software. “Details” or “Detail Drawings” means the renderings, Drawings, notes, schedules, schedule forms, and symbols contained on the compact disc(s), and on the e-Catalog page(s). “e-Catalog” means Details in “PDF” format, hardware requirements, installation instructions, license agreements, disclaimers, table of contents, pages of numbered architectural Details, notes, schedules, and symbols.
Permitted Uses	We grant you a nonexclusive license to use the Software in this Package according to the terms set forth below. The Software involves proprietary rights of Architectural Details, Inc., and others. There is no transfer to You of any title to or ownership of the Software, or patent, copyright, trade secret, trade name, trademark, and other proprietary rights related to the Software. You may not violate these rights and You must take appropriate steps to protect Our rights. You may: Operate the software on one computer at a time. Operate the software with multi-users by site license only.
Prohibited Uses	You may not: Make the Software or printed materials available to any person or entity other than Your employees. You and Your employees must use the Software as specified above under Permitted Uses. Modify the Software or merge it with another program except AutoCAD®. Reverse engineer, disassemble, decompile, or make any attempt to discover the source code of the Software. Translate or create derivative works based on the Software except as provided for in Permitted Uses. Remove, obscure, or alter any notice of the patent, copyright, trademark, or other proprietary rights related to the Software. Sub-license, sell, lend, rent, or lease any portion of the Software. Copy any portion of the Software or printed materials, except as described above under Permitted Uses. Operate the software on more than one computer at a time, except by a site license as described above under Permitted Uses. Transfer the software or any direct product to any person or entity in violation of the United States Export Administration Act. Both the license and Your right to use the Software terminate automatically if You violate any part of this agreement. In the event of any violation and termination, You must immediately destroy all copies of the Software or return them to us.
Limited 30 Day Warranty	We warrant that upon delivery by Architectural Details, Inc., the CD’s or downloaded software on which the Software is distributed will be substantially free from defects in materials and workmanship and that the Software will substantially conform to the specifications established by Architectural Details, Inc. We may, at any time, replace, modify, alter, improve, enhance, or change the Software. We do not warrant that the software is free from all bugs, errors, omissions, or viruses. If any of the Software fails to comply with the warranties set forth above, Architectural Details, Inc., will, upon notification to Us within 30 days of receipt of the Software, make a reasonable effort to correct the program error. If We are unable to correct defective disks or program errors, We will, provided You return all copies of the Software to Us, postage paid, refund Your money, less shipping and handling. You must obtain permission from Us prior to returning the Software. The refund fully satisfies Your claims for Software, Details, or disk failure. Any replacement Software will be warranted 30 days from the date You received the replacement. Except as specifically set forth above, We will not be liable for any: Bugs, errors, omissions, defects, deficiencies, viruses or nonconformities in any Software. Implied warranty of merchantability or fitness. Implied warranty relating to course of performance, course of dealing, or usage of trade. Claim of infringement. Claim in tort, whether or not arising in whole or in part from Our fault, negligence, strict liability, or product liability. Claim or any indirect, incidental, special, or consequential damages, cover, or loss of data, revenue, or use. Any written or oral information or advice given by Our representatives, distributors, agents, employees, or officers will in no way increase the scope of this warranty. You may not rely on any such written or oral communication.
Disclaimer of Details	All Details are presented as is. All Details and all connections, welding, sizing, and reinforcing are shown for illustration purposes only. No warranty is made or implied that any Detail presented is suitable for any specific structural requirement. By use of any Detail presented, You assume the responsibility that the Detail, whether used as is or as modified by You, will meet the specific requirements of Your application. You should consult Your engineer or architect regarding the use of any Detail in any application with specific code or structural requirements. The Architectural Details, Inc. designs were not prepared by or in association with UL. Sole ownership of and responsibility for these designs belong to Architectural Details, Inc.
